Government headed to a shutdown after last-ditch vote fails in Senate

WASHINGTON (AP) — Senate Democrats have voted down a Republican bill to keep funding the government, putting it on a near certain path to ashutdownafter midnight Wednesday for the first time in nearly seven years. The Senate rejected the legislation as Democrats are making good on their threat to close the government ifPresident Donald Trumpand Republicans won't accede to their health care demands. The 55-45 vote on a bill to extend federal funding for seven weeks fell short of the 60 needed to end a filibuster and pass the legislation. Senate Democratic LeaderChuck Schumer, D-N.Y., said Republicans are trying to "bully" Democrats by refusing to negotiate on an extension ofexpanded Affordable Care Act tax creditsthat expire at the end of the year. "We hope they sit down with us and talk," Schumer said after the vote. "Otherwise, it's the Republicans will be driving us straight towards a shutdown tonight at midnight. The American people will blame them for bringing the federal government to a halt." The failure of Congress to keep the government open means that hundreds of thousands of federal workers could be furloughed orlaid off. After the vote, the White House's Office of Management and Budget issued a memo saying "affected agencies should now execute their plans for an orderly shutdown." Threatening retribution to Democrats, Trump said Tuesday that a shutdown could include "cutting vast numbers of people out, cutting things that they like, cutting programs that they like." Trump and his fellow Republicans said they won't entertain any changes to the legislation, arguing that it's a stripped-down, "clean" bill that should be noncontroversial. Senate Majority Leader John Thune said "we can reopen it tomorrow" if enough Democrats break party lines. The last shutdown was in Trump's first term, from December 2018 to January 2019, when he demanded that Congress give him money for his U.S.-Mexico border wall. Trumpretreated after 35 days— the longest shutdown ever — amid intensifying airport delays and missed paydays for federal workers. Democrats take a stand against Trump, with exceptions While partisan stalemates over government spending area frequent occurrence in Washington, the current impasse comes as Democrats see a rare opportunity to use their leverage to achieve policy goals and as their base voters are spoiling for a fight with Trump. Republicans who hold a 53-47 majority in the Senate needed at least eight votes from Democrats after Republican Sen. Rand Paul of Kentucky opposed the bill. Democratic Sens. John Fetterman of Pennsylvania and Catherine Cortez Masto of Nevada and Independent Sen. Angus King of Maine voted with Republicans to keep the government open — giving Republicans hope that there might be five more who will eventually come around and help end a shutdown. After the vote, King warned against "permanent damage" as Trump and his administration have threatened mass layoffs. "Instead of fighting Trump we're actually empowering him, which is what finally drove my decision," King said. Thune predicted Democratic support for the GOP bill will increase "when they realize that this is playing a losing hand." Shutdown preparations begin The stakes are huge for federal workers across the country as the White House told agencies last week that they should consider "a reduction in force" formany federal programs if the government shuts down. That means that workers who are not deemed essential could be fired instead of just furloughed. Either way, most would not get paid. The nonpartisan Congressional Budget Office estimated in a letter to Iowa Sen. Joni Ernst on Tuesday that around 750,000 federal workers could be furloughed each day once a shutdown begins. Federal agencies were already preparing. On the home page of the Department of Housing and Urban Development, a large pop up ad reads, "The Radical Left are going to shut down the government and inflict massive pain on the American people." Democrats' health care asks Democrats want to negotiate an extension of the health subsidies immediately as people are beginning to receive notices ofpremium increasesfor the next year. Millions of people who purchase health insurance through the Affordable Care Act could face higher costs as expanded subsidies first put in place during the COVID-19 pandemic expire. Democrats have also demanded that Republicans reverse the Medicaid cuts that were enacted as a part of Trump's "big, beautiful bill" this summer and for the White House to promise it will not move to rescind spending passed by Congress. "We are not going to support a partisan Republican spending bill that continues to gut the health care of everyday Americans," House Democratic Leader Hakeem Jeffries said. Thune pressed Democrats to vote for the funding bill and take up the debate on tax credits later. Some Republicans are open to extending the tax credits, but many are strongly opposed to it. In rare, pointed back-and-forth with Schumer on the Senate floor Tuesday morning, Thune said Republicans "are happy to fix the ACA issue" and have offered to negotiate with Democrats — if they will vote to keep the government open until Nov. 21. A critical, and unusual, vote for Democrats Democrats are in an uncomfortable position for a party that has long denounced shutdowns as pointless and destructive, and it'sunclear how or when a shutdown will end. But party activists and lawmakers have argued that Democrats need to do something to stand up to Trump. "The level of appeasement that Trump demands never ends," said Sen. Peter Welch, D-Vt. "We've seen that with universities, with law firms, with prosecutors. So is there a point where you just have to stand up to him? I think there is." Some groupscalled for Schumer's resignationin March after he and nine other Democrats voted to break a filibuster and allow a Republican-led funding bill to advance to a final vote. Schumer said then that he voted to keep the government open because a shutdown would have made things worse as Trump's administration was slashing government jobs. He says things have now changed, including the passage this summer of the massive GOP tax cut bill that reduced Medicaid. Trump's role in negotiations A bipartisan meeting at the White House on Monday was Trump's first with all four leaders in Congress since retaking the White House for his second term. Schumer said the group "had candid, frank discussions" about health care. But Trump did not appear to be ready for serious talks. Hours later, he posted a fake video of Schumer and House Democratic Leader Hakeem Jeffries taken from footage of their real press conference outside of the White House after the meeting. In the altered video, a voiceover that sounds like Schumer's voice makes fun of Democrats and Jeffries stands beside him with a cartoon sombrero and mustache. Mexican music plays in the background. At a news conference on the Capitol steps Tuesday morning, Jeffries said it was a "racist and fake AI video." Schumer said that less than a day before a shutdown, Trump was trolling on the internet "like a 10-year-old." "It's only the president who can do this," Schumer said. Newly released records from Utah's Summit County Sheriff's Office appear to suggest the man accused of attacking a church in Michigan over the weekend had been arrested in Utah in 2010. According to an incident report and mugshot obtained by Scripps News, Thomas Jacob Sanford was arrested for driving under the influence after leaving a bar on March 12, 2010. A man with the same name and date of birth crashed his truck into a Church of Jesus Christ of Latter-day Saints in Grand Blanc Township, Michigan, on Sunday. Police say he then shot several people, set the building on fire, before being killed in a shootout with officers. The Utah incident report from 2010 described Sanford as driving in a vehicle that was "bouncing back and forth (side to side) in his lane." RELATED STORY |Police say no victims remain unaccounted for after shooting, fire at Michigan church During the traffic stop, the officer conducted field sobriety tests on Sanford. He described Sanford as having eyes that were "fairly blood shot and glossy." The officer also noted that Sanford appeared to have a balance problem. "Based on the driving pattern I observed, time of night (bar closing time frame), Sanford's field sobriety test observations and his breath sample, I placed Sanford under arrest for suspicion of driving under the influence," the officer wrote. According to the report, a breath test at the jail returned a .181 result. Sanford "admitted to have (sic) been drinking beer...and said that he had two, but they were 'stronger' beers. He also said he had beers at his house before going out," the officer wrote.

Tyrese Gibson failed to turn himself in to police after an arrest warrant was issued because his four Cane Corso dogs mauled and killed a neighbor's dog in Georgia in mid-September, police said Tuesday. The warrant for cruelty to animals issued for the"Fast & Furious" actoris part of an "ongoing issue" following multiple calls about the dogs in the past few months, Fulton County Police Captain Nicole Dwyer said. "Our priority is the safety of the community and when there's so many incidents of dogs, especially large dogs like this, getting out and then killing an animal, you know, what's next? A child?" Dwyer said. "Our main priority is safety and that's why we want the dogs in custody." Gibson had received multiple warnings before the warrant was issued, and police had attempted to cite him before the attack, but the actor wasn't at his Atlanta home. Dwyer said she spoke with Gibson's lawyer last week and informed them the actor had to turn himself in by Friday. Gibson's attorney, Gabe Banks, wrote to in an email to The Associated Press the actor is "cooperating fully with authorities to address and resolve this matter responsibly." Gibson wasn't home when the incident took place, Banks wrote, and "immediately made the difficult decision to rehome his dogs to a safe and loving environment." Just after 10 p.m. on Sept. 18, a neighbor of Gibson's, whose house is half a mile away, let their dog, a small spaniel, out to their yard and returned five minutes later to find the dog had been attacked. The dog was rushed to a veterinary hospital, but did not survive, Dwyer said. The four dogs were then seen at the next-door house, where the owner called police, saying she was afraid to leave her house. Animal control officers responded and were able to keep the dogs back while the neighbor went to her vehicle. Police issued a search warrant for Gibson's property on Sept. 22, but the actor and the dogs were not at the residence. Banks wrote that Gibson "extends his deepest condolences to the family who lost their beloved dog to this tragic incident." Gibson posted a video to Instagram that included various clips of his dogs early Monday. He didn't speak in the video, but rather included audio from the podcast, "The Breakfast Club," where hosts discussed the case.

Two California sisters missing for 36 years were found alive and well in their home state with the help of familial DNA, authorities investigating their case in Arizona said. When they were discovered in August, Jasmin and Elizabeth Ramos were living under new names given by foster parents who raised them in Ventura County, California, unaware of their missing status. Now authorities want to find the killer of their mother, Marina Ramos of Bakersfield, California, whose body was found with multiple stab wounds in Mohave County, Arizona, on Dec. 12, 1989, the local sheriff's office said. Jasmin was 2 months old and Elizabeth was 14 months old when they went missing that month and were found days later abandoned in an Oxnard, California, park bathroom, the Mohave County Sheriff's Office said in a Sept. 22Facebook post. "A witness walking in the area heard children crying in the women's restroom," the office said. "He asked a woman to check the bathroom, and she found the girls laying on the wet floor with no adult nearby." At the time, authorities didn't make the connection between the girls and the killed woman. "The girls were eventually adopted by a couple in Ventura County and were raised together in a loving home," the Mohave County Sheriff's Office said. The office's Special Investigations Unit, established in 2019 to revive cold cases, reopened the Ramos file at a time when the slain victim was still unidentified, her girls were considered missing and there were no suspect leads, the sheriff's office said. In 2022, fingerprints from Marina Ramos' body matched those on file belonging to a woman named Maria Ortiz, who had been arrested and fingerprinted following allegations of shoplifting in Kern County, California, in June 1989, the Mohave County Sheriff's Office said. A Bakersfield address for Ortiz led investigators to a roommate, who said she had a cousin named Marina Ramos who had been missing since 1989, the office said. "It was later learned that Maria Ortiz was an alias used by Marina Ramos," the office said. Investigators also discovered that Ortiz had two young daughters who remained missing. Mohave County Sheriff's Office investigators, led by Lori Miller, a former Los Angeles Police Department detective, got a DNA sample from a relative of Marina Ramos and used law enforcement and family DNA databases in hopes of finding the girls, the office said. They discovered one of the sisters, who said the pair had been abandoned in 1989, the sheriff's office said. The other sister kept newspaper clippings that contained news of the abandonment, it said. While the sheriff's office in Arizona celebrated the discovery, calling Miller's feat"unbelievable work,"a key portion of the case remains unsolved: who killed Marina Ramos? "The search for the suspects involved in the homicide of Marina Ramos continues," the Mohave County Sheriff's Office said. NEW YORK (AP) — Likethousands of actors,Tilly Norwood is looking for a Hollywood agent. But unlike most young performers aspiring to make it in the film industry, Tilly Norwood is an entirely artificial intelligence-made character. Norwood, dubbed Hollywood's first "AI actor," is the product of a company named Xicoia, which bills itself as the world's firstartificial intelligencetalent studio. Since the Dutch producer and comedian Eline Van der Velden launched the digital character's prospective career, Tilly Norwood has been all the talk in Hollywood. But not in a good way. Guilds, actors and filmmakers have met the Xicoia product with an immediate wave of backlash, protestingthat artificial intelligenceshould not have a starring role in the acting profession. Ina statement Tuesday, the Screen Actors Guild said that "creativity is, and should remain, human-centered." "To be clear, 'Tilly Norwood' is not an actor, it's a character generated by a computer program that was trained on the work of countless professional performers — without permission or compensation," the guild said. "It has no life experience to draw from, no emotion and, from what we've seen, audiences aren't interested in watching computer-generated content untethered from the human experience." Van der Velden, founder of the AI production studio Particle6, last weekend promoted Tilly Norwood at the Zurich Summit, the industry sidebar of the Zurich Film Festival. She said then that talent agencies were circling Norwood and that she expected to soon announce a signing. Many in Hollywood, though, hope that never happens. "Hope all actors repped by the agent that does this, drop their a$$," wrote actor Melissa Barrera ("In the Heights," "Scream") on social media. "How gross, read the room." "Any talent agency that engages in this should be boycotted by all guilds," wrote Natasha Lyonne on Instagram. The "Russian Doll" star is directing a feature titled "Uncanny Valley" that pledges to use "ethical" artificial intelligence in combination with traditional filmmaking techniques. "Deeply misguided & totally disturbed," she added. "Not the way. Not the vibe. Not the use." Artificial intelligence is often used as a tool in film production, though its implementation is hotly debated. It was a major bargaining point inthe lengthy strike by SAG-AFTRAthat concluded in late 2023 with some safeguards put in place to protect the use of actors' likenesses and performances by AI. A yearlong strike byvideo gameactorshinged on AI protections. In July, video game actorsapproved a new contractthat mandates employers obtain written permission to create a digital replica. But there have been numerous controversies over the use of AI in acting. The Oscar-winning 2024 film"The Brutalist"used artificial intelligence for Hungarian dialogue spoken by Adrien Brody and Felicity Jones' characters, the revelation of which prompted debate in the industry. Van der Velden responded to the stir around Tilly Norwood on Instagram. "To those who have expressed anger over the creation of my AI character, Tilly Norwood, she is not a replacement for a human being, but a creative work — a piece of art," Van der Veldensaid on Sunday. "Like many forms of art before her, she sparks conversation, and that in itself shows the power of creativity." Van der Velden didn't respond to interview requests Tuesday. In her post, she argued that AI characters should be judged as their own genre. "Creating Tilly has been, for me, an act of imagination and craftsmanship, not unlike drawing a character, writing a role or shaping a performance," she added. "It takes time, skill and iteration to bring such a character to life." That statement was also shared on Tilly Norwood'sown Instagram account. The Food and Drug Administration (FDA) initially reported a recall involving prepared pasta mealson Thursday, Sept. 25, while investigating an outbreak of listeria monocytogenes contamination, which can cause listeriosis and listeria poisoning. The federal agencies expanded the food safety alert this week, reporting the outbreak isnow known to have occurred in 15 states, with a total of 20 confirmed infections as of Sept. 30. Here's what to know about the updated recall, including which states have reported related listeriosis cases. Consumer Reports, the nonprofit known for testing and monitoring consumer-facing policy and products, releasedits annual risky food reportin April, naming the 10 foods of 2024 that were subject to the most recalls and/or associated with the largest illness outbreaks. WASHINGTON (Reuters) -The U.S. Transportation Department said on Tuesday more than 11,000 employees at the Federal Aviation Administration will be furloughed if government funding lapses at midnight. U.S. airlines have warned that a partial federal government shutdown could strain American aviation and slow flights, as air traffic controllers and security officers would be forced to work without pay and other functions would be halted. The Transportation Department said the FAA would continue to hire air traffic controllers, and field training of controllers would continue. During prior government shutdowns, the FAA suspended hiring and most training of air traffic controllers. More than 13,000 current controllers would be required to continue working, but would not be paid until the shutdown ended, the FAA said. The FAA has about 45,000 employees. In total, the Transportation Department would furlough 12,200 employees out of 53,717, including the FAA. The FAA also said certification activities would continue for operational safety functions of commercial airplanes and engines, as well as commercial space launch oversight and licensing. Trump secured Israeli Prime Minister Benjamin Netanyahu's backing on Monday for a U.S.-sponsored peace proposal to end the nearly two-year-old war in Gaza, but questions loomed over whether Hamas would accept the plan. In a call with reporters, Kremlin spokesman Dmitry Peskov said: "Russia always supports and welcomes any efforts by Trump aimed at ending the tragedy that is currently unfolding." He added: "And, of course, we want this plan to be implemented and for it to help bring events in the Middle East to a peaceful conclusion." Deputy Foreign Minister Sergei Vershinin later told Palestinian Authority Vice President Hussein al-Sheikh by telephone that Russia supported "any steps that will facilitate an end to the bloodshed," the Russian Foreign Ministry said. "Hope was expressed that successful implementation of the new U.S. initiative will allow for a sustainable ceasefire in Gaza, the liberation of hostages and detainees and unhindered supplies of humanitarian aid into the area," the ministry said. Moscow, it said, stood by a solution which provided for the "creation of an independent State of Palestine coexisting in peace and harmony with Israel." "Ted Lasso" is the exception, not the rule. The Apple TV+ hit is a Hollywood oddity, not necessarily a roadmap for future series. It was based on a character created for an ad for soccer coverage on NBC, combines sports comedy with mental health, Anglophile obsession, twee romanticism and the charm of its star,Jason Sudeikis. It can't really be replicated. But it's hard not to think about "Lasso" while watching Hulu's new comedy"Chad Powers"(streaming now, ★★ out of four), a similarly monikered show that takes place within a semi-professional sports team. StarringGlen Powellas a disgraced college football player who tries a second go at the game under a fake name and a prosthetic nose "Mrs. Doubtfire"-style, "Powers" goes for irreverent and goofy, but oftentimes ends up awkward and cringe. There are moments when it feels as if the show, based on an ESPN+ short that starredEli Manningas the titular imposter, is trying directly to be an American version of "Lasso," all the sunny humor with gridirons and a bigger tolerance for profanity and lewdness. Although the potential is there, the result is deeply disappointing. Fake noses, questionable Southern accents and gay panic jokes can't make up for a show that lacks soul. "Powers" is built entirely on the back of Powell, who brings out all the smarm he drummed up for "Top Gun: Maverick" and then adds some real odiousness on top. Russ Holliday, his character's true name, is a perennial screw-up. Tabloid fodder before he even makes it out of college football, the star quarterback makes a huge mistake in a Rose Bowl game that costs him his career. Eight years later a struggling college team is holding open try outs for a quarterback, so Russ thinks he should have a go at it, in disguise. Russ invents the persona of Chad Powers, who, under a wig and prosthetics and an accent that makes everyone around him call him derogatory names for mentally disabled people, somehow makes the team. What team is that? Oh right, the South Georgia Catfish, as if there was too much subtlety already in a show in which Powell wears a prosthetic nose as big as the whole of Georgia. There are flavors of "Mrs. Doubtfire" here, but also underrated Amanda Bynes 2006 high school comedy "She's the Man" and any number of Shakespearean hidden identity foibles. It's all a little bit ludicrous and witless, and not just because, though he is handsome and stately, 36-year-old Powell does not look like he could pass for a student athlete. But in spite of this, he is a magnetic personality even when he's playing an A+ jerk ("Powers" likely has the distinction of being one of the first pieces of media to define just how sleazy its protagonist is by the fact that he drives a Cybertruck). Powell commits to both Russ and Chad in an admirable way − if only the scripts lived up to his dedication. Fall TV season is fast arriving on all your streaming services and networks, and there are dozens of shows premiering, that are new, old and something in between. As you get cozy in your sweaters and with your pumpkin spice lattes, some of the biggest shows of the decade will be returning for new seasons, new series will be trying to capture your attention and new spinoffs will try to convince you everything old is new again.First up:'NCIS: Tony & Ziva'(Paramount+, Sept. 4):Michael Weatherly (Tony) and Cote de Pablo (Ziva) return to their star-making "NCIS" roles in this spy caper spinoff featuring Isla Gie as their daughter Tali. The series also can't really develop any supporting characters around Russ/Chad to bolster the series into more than a one-joke sketch. There's Danny (Frankie A. Rodriguez), Russ' accomplice who risks his own future in the fraudulent scheme seemingly just for the fun of it, after meeting Russ one time. Ricky (Perry Mattfeld), is a female coach in a male-dominated sport trying to shrug off sexism and a "nepo baby" reputation. And head coach Jake Hudson (Steve Zahn) is trying to save his job and a failing football program with his surprise new star. There is great potential for an offbeat, bawdy comedy about one of our nation's obsessions, but "Powers" always goes for the simplistic jokes and surface-level plots. Chad can't get wet and risk his prosthetics, so the team makes fun of him. Chad has no back story so he pretends he's a homeschooled shut in. The laughs are supposed to come, but they don't. It's a shame, because football is great fodder for deep storytelling in the right context. Even the show namechecks a bunch of pop culture's football stories in its first few episodes, from "Rudy" to "Radio." If "Powers" wasn't as contrived as the character itself, maybe it could stand to be on a list with those others. As it is, it's only worth cutting from your lineup. EAGLE PASS, Texas (AP) — Authorities on Monday were trying to determine why a man opened fire in the parking lot of a casino in a Texas border city over the weekend, killing two people and wounding at least five others. Keryan Rashad Jones, 34, was arrested during a traffic stop several hours after the shooting late Saturday night at the Kickapoo Lucky Eagle Casino in Eagle Pass, authorities said. Jones was arrested Sunday morning following a pursuit by authorities near Stockdale, which is about 180 miles (290 kilometers) east of Eagle Pass, according to the Wilson County Sheriff's Office. Jones faces two counts of capital murder and five counts of assault with a deadly weapon, Maverick County Sheriff Tom Schmerber said. It was unclear where Jones was being held and whether he had an attorney to speak on his behalf. Texas Department of Public Safety Lt. Christopher Olivarez said that what led to the shooting is still under investigation. The Kickapoo Traditional Tribe of Texas Police Department is leading the investigation and said the casino will remain closed while the investigation continues.

KATHMANDU, Nepal (AP) — A two-year-old girl chosen as Nepal's newliving goddesswas carried by family members from their home in a Kathmandu alley to a temple palace Tuesday during the country's longest and most significant Hindu festival. Aryatara Shakya, at 2 years and 8 months, was chosen as the new Kumari or "virgin goddess," replacingthe incumbentwho is considered by tradition to become a mere mortal upon reaching puberty. Kumaris are chosen from the Shakya clans of the Newar community, indigenous to the Kathmandu valley, and revered by both Hindus and Buddhists in the predominantly Hindu nation. The girls are selected between the ages of 2 and 4 and are required to have unblemished skin, hair, eyes and teeth. They should not be afraid of the dark. During the Indra Jatra festival earlier this month, the former Kumari was wheeled around on a chariot pulled by devotees. The Kumari always wears red, pins up her hair in topknots and has a "third eye" painted on their forehead. The weeklong Indra Jatra festival was the first of a series of celebrations including Dashain, the main festival, and Tihar or Diwali, the festival of lights, in October. Tuesday marked the eighth day of Dashain, a 15-day celebration of the victory of good over evil. Offices and schools were closed as people celebrated with their families. Family, friends and devotees paraded the new Kumari through the streets of Kathmandu before entering the temple palace which will be her home for several years. Devotees lined up to touch the girls' feet with their foreheads, the highest sign of respect among Hindus in the Himalayan nation, and offered her flowers and money. The new Kumari will bless devotees including the president on Thursday. "She was just my daughter yesterday, but today she is a goddess," said her father Ananta Shakya. He said there were already signs she would be the goddess before her birth. "My wife during pregnancy dreamed that she was a goddess and we knew she was going to be someone very special," he said. The former KumariTrishna Shakya,now aged 11 years old, left from a rear entrance on a palanquin carried by her family and supporters. She became the living goddess in 2017. Families of the Shakya clan who qualify for this prestigious seat compete to have their daughters selected. The family of the Kumari gains an elevated position in society and within their own clan. But Kumaris live a sequestered life. They have few selected playmates and are allowed outside only a few times a year for festivals. Former Kumaris face difficulties adjusting to normal life, learning to do chores and attending regular schools. According to Nepalese folklore, men who marry a former Kumari will die young, and so many girls remain unmarried. Over the past few years, there have been many changes in tradition and the Kumari is now allowed to receive an education from private tutors inside the temple palace and even have a television set. The government also now offers retired Kumaris a small monthly pension of about $110 which is slightly above the minimum wage fixed by the government.

Rebecca Shouhed watched the surveillance video in horror, as one immigration agent knocked her 79-year-old, U.S. citizen father to the ground inside his car wash business. When he got back up and went outside, two others tackled him to the pavement. An agent can be seen barreling into her father, Rafie Ollah Shouhed, she said, "bulldozing down the hallways like a linebacker." Under PresidentDonald Trump's nationwide immigration crackdown federal agents are on orders to aggressively go after people they believe are in the country illegally. The increasingly violent arrest encounters have resulted in multiple, multi-million-dollar tort claims by people – including American citizens – who say they were severely harmed or wrongfully detained during ICE operations. Department of Homeland Security leaders have accused alleged use-of-force victims of resisting arrest, assaulting agents or impeding law enforcement operations. "If you lay a hand on our law enforcement, we will prosecute you to the fullest extent of the law," DHS SecretaryKristi Noemsaidin a Sept. 19 poston the social media site X. Shouhed, the owner of Valley Car Wash in Van Nuys, California, filed a $50 million tort claim Sept. 26 against DHS and its component agencies, including U.S. Immigration and Customs Enforcement, claiming agents "illegally and unlawfully assaulted and battered" him during their operation. A DHS spokesperson said in an emailed statement to USA TODAY that agents arrested "five illegal aliens from Guatemala and Mexico who broke our nation's immigration laws" and that Shouhed "impeded the operation and was arrested for assaulting and impeding a federal officer." ICE detained Shouhed for nearly 12 hours, according to the tort claim; he was not charged with a crime. James DeSimone, the attorney representing Shouhed in his claim said the car wash owner told agents to let him show his employees' work authorization paperwork. DeSimone said surveillance video clearly shows Shouhed "isn't engaging in threatening conduct." "Instead of talking to him, they just immediately resort to force and force that was very brutal," DeSimone said. Rebecca Shouhed said she "went crazy" after seeing the video. "He has had a heart attack. He has three stents in his heart." Shouhed, the father, said in a news conference after the Sept. 9 incident, that agents only repeated: "You do not f— with ICE. You do not f— with ICE." Shouhed's isn't the first tort claim against DHS this year. In another, in August, the wife and daughter of a farmworker who died following an ICE raid on a California cannabis greenhouseclaim ICE agents clad in battle gear used "excessive force"that resulted in the fatal fall that killed Jaime Alanís, 56. Alanísdied of blunt-force head and neck injuriestwo days after the raid, according to family and the Ventura County Medical Examiner's Office. His widow and daughter are each seeking $47 million. Separately, in August, U.S. citizen and Iraq War veteran George Retes filed a tort claim against DHS seeking unspecified damages afterICE agents allegedly broke his car windowand arrested him at an ICE roadblock in Southern California and held him for three days without access to an attorney. All three claims were filed under the Federal Tort Claims Act, which can precede a lawsuit in federal court. The FTCA was created to allow people to sue the federal government when they are harmed by government employees, according to theInstitute for Justice, a nonprofit law firm representing Retes in his claim. The legislation requires plaintiffs, before suing in court, to first submit claims to the responsible federal agencies. Inits fiscal 2025 budget report, ICE said its litigation division was defending, as of fiscal 2023, more than 350 administrative tort claims seeking over $55.5 billion in damages. The agency had paid out just $813,565 in completed claims, according to the report. "It appears to be the pattern of these agents to resort to force at any time when they are questioned or confronted," DeSimone said. A 2018 policy memo– written and distributed during the first Trump administration – provides detailed guidance on when and how Homeland Security law enforcement officers may use force. They may use force "to control subjects in the course of their official duties as authorized by law, and in defense of themselves and others." To meet the standards of the 4th Amendment, the DHS guidelines require use of force to be "objectively reasonable" in a given situation. The guidelines also recognize that law enforcement officers "are often forced to make split-second judgments, in circumstances that are tense, uncertain and rapidly evolving." Use of physical force must stop "when resistance ceases or when the incident is under control." There have been few public consequences this year for ICE and other federal agents captured on video manhandling immigrants, protestors or bystanders. But an unnamed ICE agentwas "relieved of current duties" in Septemberafter video circulated showing him slamming a distraught woman to the floor inside an immigration court building in New York City. Rebecca Shouhed said she is concerned for what's to come, as Trump's crackdown widens. "Nobody is able to rein this in," she said. "It's like a free for all." "I mean, the same guy that's gonna pay them is the same guy that paid that guy to bone-saw Jamal Khashoggi and put him in a fucking suitcase. But don't let that stop the yucks, it's gonna be a good time!" Shane Gillis also disavowed the festival, saying on his "Secret Podcast" that he turned down an invitation and a "significant bag" for an appearance fee. He said, "I took a principled stand. You don't 9/11 your friends." Warner Bros. We already knewEmerald Fennell'sWuthering Heightswasn't going to be like any that have come before, but it sounds like early critics should clutch their pearls even tighter. At the Brontë Women's Writing Festival on Friday, the writer-director spoke about the forthcoming film, which starsBarbie'sMargot RobbieandSaltburn'sJacob Elordi, and likened her time adapting and directing it to "a masochistic exercise," according to theBBC. "It's an act of extreme masochism to try and make a film of something that means this much to you," she said. "I've actually found it quite harrowing, in a really interesting way." Eamonn M. McCormack/Getty Fennell explained that the book completely bowled her over when she was only 14 years old, and it has remained a favorite of hers since. "It cracked me open," she said, adding that she holds a "profound connection" to the novel. It was that which drove Fennell to dream of making her own film adaptation of Emily Brontë's tale. "I've been obsessed," she said. "I've been driven mad by this book. I wanted to make something that made me feel like I felt when I first read it, which means that it's an emotional response to something. It's, like, primal, sexual." "If somebody else made it, I'd be furious," she added. "It's very personal material for everyone. It's very illicit. The way we relate to the characters is very private, I think." That intense emotional connection, however, made Fennell's job a lot harder. "It's a terror," she said of adapting the book, "because it's a huge responsibility. But it's been a kind of masochistic exercise working on it because I love it so much, and it can't love me back, and I have to live with that. So it's been troubling, but I think in a really useful way." The masochism, however, isn't limited to Fennell's experience. Whenthe trailer droppedearlier this month, it drew attention for its highly eroticized imagery, including fingers being pushed into someone's mouth and suggestive bread kneading. The film had also alreadydrawn criticism for its unusual casting,including Robbie's age in contrast to the novel and the decision to cast Elordi as Heathcliff, rather than a person of color. "It needed somebody like Margot, who's a star, not just an incredible actress — which she is — but somebody who has a power, an otherworldly power, a Godlike power, that means people lose their minds," Fennell said. Warner Bros. Still, that trailer is barely a hint of what audiences can expect from the finished film, if Fennell's words are anything to go by. "There's an enormous amount of sado-masochism in this book," she said. "There's a reason people were deeply shocked by it [when it was published]." Audiences can expect Fennell, who's already proved unafraid of confrontational sexuality withSaltburn,to deliver on those themes in the book and them some. Warner Bros. In part because she says that she included things in the film that came out of her teenage imagination. "It's where I filled in the gaps aged 14," she explained.
